Section 4:   AREAS EXCLUDED

4.1.
Medicinal Products
Dressings in respect of which a marketing authorization has been granted pursuant to the Medicines for Human Use (Marketing Authorizations Etc) Regulations 1994 or Council Regulations 2309/93.

4.2.
Veterinary Products
Dressings sold specifically for the treatment of animals.

4.3.
Sale to the General Public
Consumer advertising directed towards, and supply to the general public.

4.4.
Measures or Trade Practices
Measures or trade practices relating to prices, margins, discounts or charitable donations which are in regular use by a significant proportion of the dressings industry. The exclusion extends to normal trade practices when supplying products solely for the OTC market.

4.5.
Replies in Response to Individual Enquiries
Replies made in response to individual enquiries from members of the health professions in response to specific communications whether of enquiry or comment, including letters published in professional journals, but only if they relate solely to the subject matter of the letter or enquiry, are accurate and do not mislead and are not promotional in nature.

4.6.
Factual Announcements
Factual, accurate announcements and reference material relating, for example, to pack changes, adverse reaction warnings, trade catalogues and price lists, provided they include no product claims.

4.7.
Product Quality and Adverse Reactions
Complaints on individual product quality and adverse reactions are excluded from this Code.

4.8.
Legal involvement
Any issue that has legal activity involved is excluded from the Code of Practice Complaints Procedure. Where legal activity is commenced in relation to a complaint already in progress the Complaints procedure shall immediately cease. Complaints cannot be raised or re-opened when legal activities have ceased.

When the outcome of any legal proceedings conclude that the Code has been breached, the findings will be published by the SDMA but additional sanctions shall not be applied.
